Yola Broke All The Rules

We still do not know how soon the Manchesters were signed on by Rayelan Smith and Morgan Gell to assist in killing off Melinda in the scheme to get her to go to Ohio temporarily to help Rayelan overcome problems she was facing.  These were lies.  The story can be viewed at:  Rumor Mill News Insights.

The likely scenario is for Craig to have begun paying Morgan, yet again, to libel, slander, and assist in his ongoing efforts to kill off her mother and brother or, at the least, leave them homeless on the street.

By googling Melinda's articles Morgan found some were up on Rumor Mill News.  Rayelan was very willing to cooperate since payment was promised and the Get Melinda, Craig Franklin and Co-Conspirators Team, funded through Craig from funds originating at GHS, comprising Morgan Pillsbury Gell, Jaue E. Gell, Laura Smith Montagu, Alex, 13th Duke of Manchester, and Rayelan Smith, who brought in her two best friends, Laura and Alex, were ready to destroy Melinda.

In the salutation in the email above one name is whited out. The name has to be short.
Why would Yola, Inc. have consented to do a search of sites on behalf of Laura, Alex, and another person? One name which would fit there is 'Craig.'

Craig Franklin, my former husband, is a sexual predator who lied to me, battered and abused me while we were married. DECLARATION, Ayn Pillsbury All of the children witnessed these abuses.

I knew, having received word of his involvement, Craig had been contacted by Laura, providing her with the names and contact information for numbers of my friends and children.

Craig is an ugly character.

His first sexual arousal took place with his sister when she was 12 years of age. He was some years older. This was reported both to myself and to Anne Fisher, a woman he dated for some years after our divorce.
Fisher first contacted me in 2003 and again emailed me in 2009 with the news Craig's son, Jonathan Scott Franklin had been arrested. At that time Anne and I began talking frequently, these conversations continuing for over a year during which time she sent me copies of emails and photos along with other evidence.

Craig reported to Fisher one of his first memories was being beaten by his mother with a Bible late one night. Mrs. Franklin was dressed in a revealing nightgown and immediately afterward had sex with his father with their bedroom door open. Both Fisher and I had each been told the same stories many years separated in time.

After the divorce I discovered Craig's sexual fantasies focused on the rape of young girls with whom he had a close, familiar relationship. This realization began with this magazine, which focused on incest. It was found by a private investigator I hired to ascertain his address for purpose of service of process. He saw Craig deposit the bag of trash at his condo, waited until Craig lumbered off, and grabbed it. The bag was first opened on my dining room table.

Along with it was a receipt from an adult bookstore on State Street in Santa Barbara. His name is very visibly on the receipt which was tucked into the book, found in the bag.

Craig's son from his first marriage, Jonathan Scott Franklin, was found guilty on May 27, 2010. An article appearing in the Appeal Democrat was quoted as saying about the conviction, “ Jonathan Scott Franklin was sentenced Wednesday to 10 years to life for hiring a "hit man" to kill his estranged wife in Marysville and her boyfriend — a sentence that came after the woman said that unless he was locked up, Franklin would try to find her.

Kathleen Franklin, 35, said on a videotape played in Yuba County Superior Court that she suffered a decade of verbal abuse from Franklin before his arrest last July as he drove away from a meeting with an undercover officer posing as a hit man.

Kathleen Franklin said that after she filed for divorce, Jonathan Franklin quoted e-mails she had written. She said she learned he'd installed spyware to steal her passwords and made video recordings of her through the webcam on her computer.

"I was just terrified to be around him," she said, recalling how one evening two Marysville police officers spoke with her and said, "We don't know how to tell you this, but your husband has hired a hit man to kill you."

Craig's reaction to the arrest of his son was to immediately attempt to gain unsupervised visitation to his grand-daughter, then eight years of age. The child's mother told me during a phone conversation Franklin ignored his grandson, who was two years older, focusing his attention on the young girl. The court denied Franklin visitation because, according to the mother, his behavior toward the girl was inappropriate.

I realized then why Craig had asked me to marry him. I had three daughters, all beautiful and all of the age which he found most sexually arousing.

Franklin insisted on adopting all of my children, ensuring my former husband, Ron Foster, would be out of the picture. He insisted Ron cede his parental rights and immediately named the children as his natural heirs. Only after the marriage had ended did I realize how ugly his behavior had been. One of my daughters came to me and told me he had routinely exposed himself to her when I was absent from the home.

Craig took his attorney, Jacqueline Misho, into the family home before informing me of his intentions and allowed her to steal his Will. Only because this copy was later found in my graphics books do I have a copy today. Misho also stole my personal papers, which was both a violation of law and ethics.

Misho, for the record, has a reputation for ugliness. She figured prominently in the After Divorce Tour of John Cleese, having represented his wife in that action.

Although these facts were made known to the court, they were ignored.

In late January I put up a site and began fighting back with the truth. Evidently, the Manchesters, Craig, and their co-conspirators were not prepared for this.

Laura copies Franklin on the ugly, slanderous, and harassing emails with which she continues to hammer me.

3 Exhibit 19 - IRS - May - Letter on Need to Protect the Disabled.

Dear Sir or Madame,

In February I wrote a letter to you regarding my husband, Craig Franklin, who had not filed a tax return in 25 years.  I was not aware that Craig was not filing.  In fact, I believed that I had succeeded in bringing him up to date, and had initiated the preparation of tax returns for 83 - 87 and paid the bill to the accountant.

I wrote asking for help with a very painful  situation that has almost ruined us financially and come near to killing my husband.  All I received from you were demands for more money - that we don’t have and never owed.

Craig is now under the care of a psychologist who is helping him sort out the source of this deep-seated phobia regarding all paper work. - and all authority figures.   I have personally sorted through 29 cartons of papers dating from the late 60’s.  It was in the course of this excavation that I discovered the never-mailed tax returns at the bottom of carton 9 (Saturday night around 11:00 p.m.)   In the cartons were unopened letters from family members, traffic tickets, some over 20 years old, and an astonishing array of stuff that I will not bore you with.  I have no idea how it was possible for him to deceive me, his birth family, and others.  But he is extremely intelligent, his IQ is high enough to qualify him for Sigma, and so his therapist was not actually surprised at his ability to avoid confessing to his problem for so many years.

As I said in my earlier letter,  Craig was diagnosed with adult on-set diabetes as well and this has necessitated many changes for him  - including my going into the office to organize his work.  Otherwise I still might not know.

But now I do know and I understand the emotional burden that Craig has carried all of these years.  He could not file.  He could not admit to his inability because of a condition that has existed since he was a young child.  But the most shocking  thing that I saw was that although he, because of his disability broke the law, he was not charged with non-filing.  Even though it must have been obvious to you, or someone in the IRS that not filing was costing him much, much more than simply hiring an accountant.

If you had charged him this condition would have been revealed years ago and he could have not been subjected to the stress and grinding fear that brought on him diabetes and almost forced him to suicide.

I was appalled.  I want several things.

First, I want to know what you are going to do to repair the damage you have done to this man, and second, I want  to know what you are going to do to prevent this from happening to others in similar situations.

it  goes without saying that we would pay no fines, penalties or interest.  I have been unable to find out exactly how much money has been levied over and above that which was lawfully owed, but every penny should be returned immediately.

I have no objection to paying what is rightfully due, but the shocking way in which this matter has been handled alarms me both for us and for others caught in similar situations.

The Americans with Disabilities Act guarantees that individuals such as my husband will not be treated like this.  He was incapable of filing paperwork - not or not paying what he owed.

I have been under treatment for a heart condition. (Both of my sisters died of heart attacks in early middle age, one at 36 the other at 59.)  My younger brother just had open heart surgery.  I want to know what you are going to do to stop this abuse of those who are emotionally disabled.

I hope to hear from you as soon as possible.

Sincerely,

2003 - August 18th - 23 PM 1:18:23 PM Pacific Daylight Time – Email from Todd Porter to Laura Dewey regarding falsification of income by Craig Franklin.

From:  Todd Porter, California Bar No. 148993

To:       Laura Dewey, California Bar No. 108294

 Dear Laura:

The email follows our conversation regarding some ideas I've developed to flush out the great likelihood that Craig has hidden his money, committed a fraud on the court, and otherwise done everything in his power to thwart Melinda's right of support.

In handling the trial for Melinda, you obtained for her an interest in certain stock options, which were the security for a "nonrecourse" loan with GHS.  The terms of the deal are unimportant for this conversation, other that to say, I refer to these stock options as the OLD options.

Subsequent to the divorce, I was suing Craig and GHS.  I deposed both Mr. O'Dowd, and Craig.  What I learned is illuminating.

At the time of O'Dowd's deposition, he and Craig were negotiating a deal for additional stock options, which I will refer to as the NEW options.  This, in and of itself is a form of undisclosed income.  However, putting that issue aside, they had gotten as far as a range for these NEW options between 400,00 and 650,000.  [Note, I have sent to Melinda a copy of this deposition, I have a certified copy here in the office as well.]

I also learned from Mr. O'Dowd the following important things.  First, his compensation agreement has never been reduced to writing.  The way it works is that Craig first has to submit a "commission report" to Dan, which Dan then approved (or disapproves) and he is paid.  Two things are to be learned from this.  The first is what Melinda has told us for forever, is that Craig has control over when he receives his income, but virtue of the fact (there may in fact be other ways) that it is HE who must first submit the report to Dan to be paid.  Second, the terms of his compensation agreement can be discerned from the reports.  Third, I learned that there was a precedent for Craig to divert income to exercise the stock option.  This fact actually happened with respect to the OLD options, and Dan detailed that occurrence in his deposition.

So, Craig lowered Melinda's support, by making a claim (false) that his earning were down.  What I'd suspect that you will find, is that A.  A deal was in fact consummated for NEW stock options.  B.  Craig may have intentionally delayed submission of commission reports and/or C.  Craig had income applied towards the exercise of the stock options, which was not disclosed to the court.

This is in keeping with Craig's character, his course of conduct, his opportunity, and is consistent with his BIG year the next year.  Also, his claim of lower income is inconsistent with GHS financial results, which they publish on their web site, showing earnings growth in EVERY year.  See. www.ghs.com

So, my advice, would be to subpoena directly from GHS all of his stock options agreements, all evidence of any payment to exercise any options (OLD or NEW), all commission reports, and you will find, I'd bet, he's screwed Melinda, and committed a fraud of the court.  I'd seek the most severe sanctions possible, and make this a part of an effort to extend support.

Happy Hunting,

Todd”

IRS Refunds begin

The first refund check was for $44,000.  In all, we received about $250,000.  Craig reneged on his promise to give me the money.  I had kept what I was doing with it as a surprise.  I paid all of our bills so all we had was the mortgage and car payment.

What Craig did do was to ask the court to force me to pay the money back - to him.  I produced proof I had paid our overdue bills but he only scowled, visibly disappointed.
